Hereinafter referred to as the Operator or BackpackerPack. The following General Terms and Conditions apply to all customers of BackpackerPack. BackpackerPack is entitled to amend or supplement these General Terms and Conditions, including any attachments, with reasonable notice at any time. Orders received prior to the changes will be processed based on the still valid old General Terms and Conditions.

Validity of the Terms and Conditions, Scope of Application, and Special Regulations

BackpackerPack offers individual tourist services (Greyhound Bus Tickets/Passes from Greyhound Australia) on bus-backpackerpack.com, acting as a travel agency.

The following general regulations or references to the corresponding separate conditions can be found below.

I. General and Information Provision

1. Conclusion of Contract

1.a By providing personal information and clicking a button, the customer makes a declaration of intent (offer under §145 BGB), and with its acceptance (under §147 BGB) by BackpackerPack, a contract is concluded. BackpackerPack is not obligated to accept an order in any case and expressly reserves the right to errors and prior sale.

1.b The tickets are issued to the personal data provided when ordering. The customer must therefore ensure that the order is made with the personal data of the actual passenger (especially first name, last name and email address). These must necessarily match the passenger. A subsequent change after ordering is no longer possible.

2. Payment Terms and Pricing

2.a BackpackerPack accepts various payment methods (processed through Shopify Payments). A complete list of payment options valid for your country is displayed by Shopify Payments in the checkout process.

2.b Orders can only be processed once full payment has been made by the customer.

2.c In case of late payment, BackpackerPack is entitled to charge a reasonable reminder fee. All price and fee information (whether on the website, in offers, within customer communication, or elsewhere), unless expressly stated otherwise, is always to be understood as per person.

3. Delivery and Delay in Delivery

BackpackerPack endeavors to process all orders for Greyhound Tickets within 3 working days and to transmit the ticket to the customer (shipment is handled directly by Greyhound Australia). Delivery and performance deadlines are extended reasonably for BackpackerPack in case of disruptions due to force majeure and other obstacles not attributable to BackpackerPack, insofar as such obstacles, such as disruptions in self-supply, strikes, operational disruptions, etc., have a more than insignificant impact on the delivery or performance of BackpackerPack or in case of corresponding problems/delays with the ticket sender (Greyhound Australia), for which BackpackerPack assumes no liability.

4. Right of Withdrawal and Consequences of Withdrawal

Cancellation/exchange/rebooking is excluded for this special offer by us (applies to all Greyhound products offered in this shop). It is also precautionarily noted that there is no right of return for travel services in the sense of distance selling.

5. Warranty / Liability

5.a The warranty is provided in accordance with legal regulations. However, the following special conditions apply to damage claims: BackpackerPack's liability for damages, regardless of the legal basis (especially in the case of default, defects, or other breaches of duty), is limited to the contract-typical, foreseeable damage. The above limitations of liability do not apply to BackpackerPack's liability for intentional conduct or gross negligence, for guaranteed characteristics, for injury to life, body, or health, or under the Product Liability Act. BackpackerPack does not guarantee the accuracy, completeness, and timeliness of the information on the website. BackpackerPack generally disclaims liability for any damages, whether physical, financial, or otherwise, arising from the information provided here, following the tips, or other behavior resulting from reading the published information. The terms and conditions of carriage and terms and conditions of Greyhound Australia apply. BackpackerPack is not responsible for accidents during the journey. BackpackerPack is not liable for the product characteristics of the passes or the inclusive services advertised by Greyhound Australia (and not for their temporal availability). Any route maps or timetable information depicted are exemplary representations without guarantee (and may deviate from the actual timetable or route network). Only the official information from Greyhound Australia, which can be accessed on the Greyhound Australia website at: greyhound.com.au, is valid.

5.b In no case can BackpackerPack be held liable for damages incurred by the user due to incorrect information from our web content. BackpackerPack is not liable for the unauthorized acquisition of personal user data by third parties (e.g. through unauthorized access by "hackers" to the database). BackpackerPack does not guarantee the accuracy, completeness, and timeliness of the web content. BackpackerPack generally disclaims liability for any damages, whether physical, financial, or otherwise, arising from the information provided on the website, following tips, or other behavior resulting from reading our information. BackpackerPack cannot be held liable for the misuse of information and data that users have made accessible to third parties.

6. Copyright

The information offered by BackpackerPack with all its components and information sections on the website is protected by copyright and may only be reproduced or processed in any form with the prior consent of the author/creator or BackpackerPack. Information on the author and contact details can be obtained from BackpackerPack at the above address. Unauthorized and therefore illegal disclosure can be prosecuted. Any copying, processing, commercial use, publication, or resale, in whole or in part, is only permitted with the written and prior approval of the author. All logos and illustrations, both of the products and all other images on this website, are also protected by copyright. The buyer is only entitled to use the content published on our website for their own purposes. The trademark "BackpackerPack" is a registered and protected trademark at the relevant trademark office, provided by the trademark owner, Christof Hock, through a contract. The exact contact details for the trademark owner can be obtained from BackpackerPack. In the event of any infringement of the trademark rights, both BackpackerPack and the trademark owner reserve the right to assert claims against the infringer or their assistants.

7. Miscellaneous

The assignment of rights and claims from a concluded contract requires the prior consent of the other contracting party. This does not apply to the assignment of purchase price claims. Subsequent additions or amendments to contracts require written form. This also applies to any waiver of the written form requirement. If individual provisions of these General Terms and Conditions are or become invalid in whole or in part, this does not affect the validity of the remaining provisions. If the customer is a merchant, legal entity under public law, or a public-law special fund, the place of jurisdiction for all disputes arising from this contract is agreed to be the registered office of BackpackerPack. The same applies if the customer has no general place of jurisdiction in Germany or if the place of residence or habitual residence is not known at the time of filing the lawsuit. However, BackpackerPack is also entitled to file a lawsuit at the customer's registered office.

III. Product Descriptions

Only the product descriptions from Greyhound Australia apply. For product descriptions and inclusive services of the respective products, please visit the Greyhound Australia website (https://www.greyhound.com.au/). BackpackerPack does not provide product descriptions in this shop. In the shop, we limit ourselves to the pure product designation (name of the ticket), which allows you to recognize which Greyhound product you are purchasing. The absence of a product description is not a reason for revocation, cancellation, or complaint of the order.

IV. Data Protection Provisions

The use of the web services of BackpackerPack is subject to the valid data protection provisions. BackpackerPack has made detailed regulations for this, which can be read in the "Data Protection Provisions" section.
